Terms of Service

§1 General provisions

  1. These terms govern the use of the duckcollect web service (the "Service").
  2. The Service is operated by Duckcollect (the "Operator"). Contact: [email protected].
  3. Using the Service requires accepting these terms. Acceptance happens at account registration.
  4. The Service is used to manage trading-card collections, to run preliminary condition analysis (including with algorithms and AI models), and to match users interested in buying and selling cards.

§2 User accounts

  1. Registration is free and requires an e-mail address and a username.
  2. The user agrees to provide truthful information and not to share the account with third parties.
  3. The Operator may block or delete an account that violates these terms, in particular one used for fraud, spam, or circumventing Service restrictions.
  4. The user may delete their account at any time in the profile settings.

§3 Listings and transactions between users

  1. The Service lets users publish card-sale listings and contact each other as buyer and seller.
  2. THE OPERATOR IS NOT A PARTY to transactions concluded between users. The sale agreement is made solely between the buyer and the seller.
  3. The Service does not broker payments. Settlement (e.g. bank transfer, BLIK, cash on local pickup) happens directly between users, outside the Service, at their own risk.
  4. The seller is solely responsible for the content of a listing, including how faithfully the description matches the actual card (condition, authenticity, completeness).
  5. The parties to the transaction are solely responsible for choosing the payment and delivery method, dispatch, transport and receipt of the parcel.
  6. To the extent permitted by law, the Operator is not liable for: (a) non-performance or improper performance of the agreement by either party, (b) the card not matching the description or its defects, (c) loss, damage or delay of the parcel, (d) non-payment or other damages arising from transactions between users.
  7. The above exclusions do not limit any liability of the Operator arising from mandatory provisions of law, in particular towards consumers.
  8. In case of a dispute between users, the Operator may — but is not obliged to — provide the other party with data necessary to pursue claims, and may block an account violating these terms.

§4 Card condition analysis reports (AI grading)

  1. Reports generated in the Service (including numeric scores, suggested conditions and AI "second opinions") are EXCLUSIVELY INDICATIVE and informational.
  2. A report is not a certificate, an expert appraisal, or official grading (in the sense of services such as PSA, CGC, TAG, etc.) and gives no assurance as to a card’s condition, authenticity or value.
  3. Analysis results depend on the quality of the supplied photos. The Operator does not guarantee that a report matches the actual condition of a card and is not liable for decisions (including purchases) made on its basis.
  4. A report verification code confirms only that a given person saved the report in the Service — it does not confirm the condition or authenticity of the card.

§5 Valuations and market data

  1. Valuations and market prices shown in the Service are estimates, come from automated aggregation of public sources and user offers, and may be outdated or wrong.
  2. Valuations are not an offer, investment advice, or an assurance of card value.

§6 Prohibited content

  1. Publishing unlawful or misleading content is prohibited — including listings for counterfeit cards or proxies presented as originals — as is content violating third-party rights or good practice.
  2. Actions disrupting the Service are prohibited, including automated data scraping without the Operator’s consent and circumventing limits and protections.

§7 Complaints about the Service

  1. Complaints about the technical operation of the Service can be sent to the Operator’s e-mail address indicated in §1.
  2. The Operator handles complaints within 14 days of receipt.
  3. Complaints concerning transactions (e.g. card condition, parcels, payments) must be addressed directly to the other party of the transaction — per §3 the Operator is not a party to the sale agreement.

§8 Personal data

  1. The Operator is the controller of users’ personal data. Data is processed to provide the Service.
  2. Details of data processing are set out in the privacy policy at /privacy.

§9 Amendments and final provisions

  1. The Operator may amend these terms for important reasons (e.g. legal changes, new Service features). Users will be notified in the Service at least 14 days in advance.
  2. Using the Service after amendments take effect constitutes their acceptance; the user may delete the account at any time.
  3. Polish law applies to matters not covered here.
